Breach of contract

If you don’t fulfil your obligations according to the registrar agreement, we will contact you and ask that you correct the situation. If you do not correct the situation, it could result in the termination of the agreement.

In some instances the breach is so serious that the agreement can be terminated immediately. This is called ‘material breach’ in the registrar agreement, and some examples of this are:

  • Misuse of our systems or of the database, for instance by breaking our regulations for acceptable use or Intellectual Property rights to our customer database.
  • Document forgery, for instance back dating applicant declarations.
  • Repeated attempts to prevent the holder from changing registrar. For instance by setting the contact information of the holder to the registrar’s contact information or by refusing to give the holder the authorisation code for a domain within the time limit.

If an agreement is terminated due to breach of the agreement, an application to establish a new registrar agreement will be automatically refused for 12 months after the termination. If you apply after the 12 months, we will process your application and consider whether you fullfil the requirements to become a registrar.
